By accessing or using OmniaLuce.Tech services, including our website, platforms, and volunteer opportunities (“Services”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use our Services.

About OmniaLuce

OmniaLuce is a volunteer collective dedicated to leveraging technology for good. We are organized as an association under the laws of Brazil, with our headquarters located in Brasília, Distrito Federal.

Volunteer Participation

Volunteer Status

Participation in OmniaLuce is voluntary. Volunteers are not employees, contractors, or agents of the organization. No compensation is provided for volunteer services.

  • Collaborate respectfully with fellow volunteers and partner organizations
  • Maintain confidentiality when handling sensitive information

Intellectual Property

Volunteer Contributions

By contributing to OmniaLuce projects, you agree that:

  • Your contributions are made voluntarily and without expectation of compensation
  • You grant OmniaLuce a perpetual, worldwide, royalty-free license to use, modify, and distribute your contributions
  • Your contributions do not infringe on third-party rights
  • You retain ownership of your pre-existing intellectual property

Open Source Commitment

We are committed to open source principles. Our code and documentation are typically released under open source licenses, allowing others to use, modify, and distribute our work.

Third-Party Content

You are responsible for ensuring that any third-party content you use in your contributions is properly licensed and does not infringe on others’ rights.

Acceptable Use

Permitted Activities

  • Contributing to technology projects that advance our mission
  • Participating in community discussions and knowledge sharing
  • Using our platforms and tools for collaborative work
  • Representing OmniaLuce at events and conferences (with approval)

Prohibited Activities

  • Using our Services for illegal or unauthorized purposes
  • Harassing, threatening, or discriminating against others
  • Sharing confidential information without authorization
  • Attempting to gain unauthorized access to our systems
  • Misrepresenting your affiliation with OmniaLuce
  • Using our platforms for commercial promotion unrelated to our mission

All participants must adhere to our Code of Conduct, which includes:

Liability and Disclaimers

Limitation of Liability

To the fullest extent permitted by law, OmniaLuce and its volunteers shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from your use of our Services.

Disclaimer of Warranties

Our Services are provided “as is” without warranties of any kind, either express or implied. We do not guarantee that our Services will be uninterrupted, secure, or error-free.

Indemnification

Termination

Voluntary Termination

You may terminate your participation in OmniaLuce at any time by notifying us and ceasing to use our Services.

We may terminate your access to our Services if you violate these Terms or our Code of Conduct, engage in misconduct, or for other reasons at our discretion.

Effect of Termination

Upon termination, your right to use our Services ceases immediately. Provisions regarding intellectual property, confidentiality, and liability shall survive termination.

Dispute Resolution

Informal Resolution

We encourage resolving disputes through direct communication and our internal conflict resolution processes.

Formal Procedures

If informal resolution is unsuccessful, disputes shall be resolved through:

For Brazilian Data Subjects:

  • Mediation through Brazilian consumer protection agencies
  • Arbitration under Brazilian Arbitration Law (Lei 9.307/96)
  • Brazilian courts with jurisdiction in Brasília, Distrito Federal

For EU Data Subjects:

  • Complaint to relevant EU supervisory authority
  • Mediation through EU dispute resolution mechanisms
  • Courts in your EU member state of residence

For Other Data Subjects:

  • Online dispute resolution platforms
  • Brazilian courts as last resort

Governing Law

These Terms are governed by:

  • Primary Jurisdiction: Brazilian law
  • EU Data Subjects: GDPR and applicable EU member state laws for data protection matters
  • International Volunteers: Brazilian law with recognition of applicable local consumer protection laws

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

Changes to Terms

We may modify these Terms periodically. Material changes will be communicated through:

  • Website notifications with 30-day advance notice
  • Email to active volunteers
  • Community platform announcements

For Brazilian Data Subjects: Changes affecting data processing will be communicated with clear explanation of changes and options to object (LGPD Article 9).

For EU Data Subjects: Changes affecting data processing will require renewed consent where consent is the legal basis (GDPR Article 7).

Continued use of our Services after the notice period constitutes acceptance of the new Terms, except where additional consent is required by law.
